- Open to employers who want to hire workers in permanent jobs that require greater than high school education.
- Employers search for and choose own foreign workers.
- Works well for employers who can wait until the worker gets permanent resident status in Canada before starting work.
- If program requirements are met, can also be used to hire foreign family members.
- No need to demonstrate that efforts were made to hire Canadians.
Role of the Canadian Employer
Step One: Have a suitable business
- Need an employee to work in a full-time, non-seasonal job that requires greater thanhigh school education.
- Have a business that has been in operation, on a continuous basis, for at least one year.
- Have employed at least one full-time employee (other than themselves) on a continuous basis for at least one year.
Step Two: Locate employee, apply
- Locate a suitable foreign national.
- Send the appropriate application form and to Service Canada/Human Resources and Skill Development Canada. The application forms are found at this website.
- Provide evidence that his/her company has been in continuous operation for at least a year and that they have employed a worker for at least a year (continuously)
Step Three: Demonstrate suitability
- Demonstrate that wages and working conditions offered are consistent with what Canadians receive when doing this kind of work.
- Demonstrate that the job requirements are usual for the occupation.
- Formally declare that there is not a labour dispute in progress at the employer’s firm.
Step Four: Contact Employee
If the application is approved by Service Canada/Human Resources and Skill Development Canada, employers must:
- Send foreign national a copy of Service Canada/Human Resources and Skill Development Canada’s approval letter and advise him/her to apply for permanent residence at a Canadian Consulate, Embassy or High Commission.
Step Five: S.I.N. and conditions
If Citizenship and Immigration Canada approves the foreign national’s application for permanent residence, employers must:
- When foreign national arrives, view the permanent resident document.
- Ensure foreign national obtains Social Insurance Numbers (SIN’s). If he/she already holds a SIN ensure that it has been updated.
- Adhere to the terms and conditions of the employment agreement.
Role of the Employee
Step One: Job offer, skills passport
- Be offered full-time, year-round position in a job that requires greater than high school education.
- Have the skills, education and experience needed for the job.
- Have a copy of Service Canada/Human Resources and Skill Development Canada’s approval letter (that the Canadian employer sent).
- Have a current, valid passport.
Step Two: Apply
- Send the appropriate application form, application fees and a copy of Service Canada/Human Resources and Skill Development Canada’s approval letter to Citizenship and Immigration Canada. Include any other documents required. Such things as police certification, proof of education, proof of employment history and a medical examination are required.
- Later in the process, Citizenship and Immigration Canada may ask the foreign national to report for an in-person interview. If that is the case, he/she will be given instructions.
Step Three: Adivse employer
Citizenship and Immigration Canada will assess the application and advise the foreign national of the decision. If the application has been approved, Immigration officials will send the foreign national a letter called a Confirmation of Permanent Residence (COPR).
The foreign national must then:
- Advise the Canadian employer that the request has been approved and must arrange a date to begin work.
- Make arrangements to travel to an area near the employer’s place of business
- If bringing furniture, equipment or items of high value to Canada, contact Canada Customs and Revenue Agency for instructions.
Step Four: Arrival
On arriving at a Canadian airport or border crossing, the foreign national must:
- Show a Canadian Immigration Officer the Confirmation of Permanent Residence (COPR) letter,
- If foreign national is given final approval to enter Canada, the Canadian Immigration Officer will give the foreign national a work permit.
Step Five: S.I.N., begin work
- If foreign national does not have a Social Insurance Number, apply fo one. If foreign national already holds a Social Insurance Number, apply to have it updated.
- Begin working for the Canadian employer.
